LAW P 502 Trademark and Trade Secret Law

Businesses of all types use trade secrets and trademarks on a regular basis. Thus, knowledge of trade secret law and trademark law is particularly valuable to all intellectual property and business lawyers. The course will explore issues relating to the protection of trade secrets under state and federal law. Topics include the philosophical bases and policies underlying trade secret protection; the role and nature of measures used to protect trade secrets; the proper and improper means of acquiring trade secrets; non-disclosure agreements; and the role of remedies. The course also will explore issues relating to the protection of trademarks and other trade identity symbols under state and federal law. Topics include the philosophical bases and policies underlying trademark protection; the distinctiveness requirement; protection of trade dress and product configurations; priority of usage; infringement and dilution; and the role of remedies.
