LAW A 582 Bankruptcy

This course will examine federal bankruptcy as it relates to individuals, businesses and municipalities. Chapter 7 (liquidation), Chapter 9 (municipal debt adjustment), Chapter 11 (business reorganization) and Chapter 13 (repayment plans for individual with regular income) cases will be examined. Topics included are bankruptcy court structure, eligibility for Chapter 7, Chapter 11, and Chapter 13, property of the bankruptcy estate, the automatic stay, exempt property, non-dischargeable debts, requirements of the Chapter 11 and Chapter 13 plans, treatment of executory contracts and leases, and the avoiding powers of the trustee.
