LAW A 582 Bankruptcy

Credits: 3-4, Variable


This course will examine federal bankruptcy as it relates to individual consumers. Chapter 7 (liquidation) bankruptcy cases, Chapter 11 (business reorganization) and Chapter 13 (repayment plans for individual with regular income) cases will be examined in detail. Topics included are bankruptcy court structure, the roles of the Chapter 7, Chapter 11, and Chapter 13 trustee, eligibility for Chapter 7, Chapter 11, and Chapter 13, property of the bankruptcy estate, the automatic stay, exempt property, non dischargeable debts, requirements of the Chapter 11 and Chapter 13 plans, treatment of executory contracts and leases, and the avoiding powers of the trustee.
