Open source software presents businesses with important challenges and opportunities. Budget pressures and technology considerations make open source software a potentially attractive alternative to proprietary software. At the same time, however, failure to understand often complex intellectual property issues arising from open source licensing terms can lead to inadvertent risk exposure. This roundtable will focus on legal considerations surrounding the use of open source software, including the ongoing evolution of open source license terms and attempts to reconcile the proprietary and open source license models.

PRESENTERS:

Bob Gomulkiewicz directs the University of Washington School of Law’s Intellectual Property Law & Policy Program.  Prior to joining the UW Law faculty he was an Associate General Counsel for Microsoft where he led the team of lawyers providing legal counsel for development of Microsoft’s major systems software, desktop applications, and developer tools products.  His publications include articles on open source software, mass market licensing, and legal protection for software.

Cestjon McFarland is a partner in and former chair of the Intellectual Property practice group at Preston Gates & Ellis, LLP.  Her practice involves representing public and private technology companies in a range of transactional matters involving the protection, acquisition, development and licensing of intellectual property, including the review and analysis of open source agreements and the development of open source policies.

Lawrence E. (Larry) Rosen is both an attorney and a computer specialist who often publishes and speaks around the world on open source licensing and patent issues. He is founding partner of Rosenlaw & Einschlag, a technology law firm with offices in Los Altos Hills and Ukiah, California, and general counsel of Open Source Initiative. Larry's book, "Open Source Licensing: Software Freedom and Intellectual Property Law," was published by Prentice Hall in 2004.
