Winter 2010: Pakistani and Afghan Law, Lombardi, 1 credit

“Winter 2010: Social Movements, the Political Process, and the Development of Law: A Civil Rights Case Study, Miller, 4 credits”

By examining civil rights history and laws, this seminar will explore the relationship between social movements, the legislative development of statutes, and the judicial enforcement of those statutes. Laws prohibiting employment discrimination on the basis of race, gender, and disability (in addition to the proposed statute seeking to prohibit employment discrimination on the basis of sexual orientation) will be used as case studies to understand how the political process intersects with and impacts the development and interpretation of law. Statutes are often developed and passed as the result of historical and political processes, and those same historical and political contexts impact how courts interpret those statutes. Students will enhance their understanding and skills in the areas of legislative history, statutory interpretation and civil rights legal history.
