LAW H550 Medical Products Liability Law

This course will focus on product liability claims associated with the design/development, manufacture, marketing and distribution of medical devices and pharmaceuticals. The concepts of strict liability, negligence, breach of warranty and informed consent will be considered in this context. The class will analyze the relative roles of state and federal law, as well as the impact of FDA regulation and product approval. The use and impact of multi-district litigation and class action lawsuits will also be studied.
